CONCILIATION/MEDIATION

Conciliation is used in Irish contracts and has become a successful tried and tested Alternative Dispute Resolution (ADR) process. It is a voluntary process with both sides committing to a mutual settlement with the assistance of a conciliator/mediator. The success relies on the willingness of the parties to engage and participate in the process. It allows people to tell their side of the story and the conciliator/mediator will give the parties the best shot at doing a deal. If the parties cannot reach settlement at conciliation under the normal procedures then the conciliator is required to issue a recommendation as to how he or she believes they should settle their dispute. In the construction industry it is believed that this method of dispute resolution has circa 90-95% success rate. The methods are alternatives to arbitration and litigation, quicker resolution and less cost.
